Dr. Ayariga files for Injunction in Land Case
Dr. Hassan Ayariga, founder of the All People’s Congress, has filed a motion for interlocutory injunction to restrain the Ga East Municipal Assembly from demolishing his wall, pending the final determination of his suit against the Assembly.
The motion has been filed, following a Writ issued by Dr. Ayariga, claiming, among others, that the Respondent had demolished part of a fence wall he put up around his parcels of land, situated around the Ghana Atomic Energy Commission (GAEC).
It is the case of Dr. Ayariga that sometime in June 2018, officers of the Defendant/Respondent, approached him for the purposes of securing a building permit for a fence wall he was construction on the said land, for which he issued a cheque, together with other documentary requirements.
The Plaintiff/Applicant avers that the officers returned with the excuse that they preferred cash payment, which he refused, to avoid pilfering of government resources.
According to the APC founder, out of anger and show of brutal force, officers of the Defendant/Respondent, under the guise of undertaking their usual or lawful activity, demolished portions of his fence wall.
The Plaintiff/Applicant, through his lawyer, is expected to move the motion on 17th September, 2018.
